The undersigned “Customer” has hired Foam It Up, LLC  herein referred to as “Foam It Up” to provide a foam party at your address described below here in referred to as the “Event” In consideration of the services to be provided by Foam It Up, and in addition to the fee for the services to be paid to Foam It UP, LLC by the Customer, the Customer agrees as follows:
You the Customer and your guests are participating in a “FOAM PARTY” at your own risk, which you voluntarily assume. Although we have taken precautions to make this party safe and enjoyable, we cannot and do not guarantee that accidents or other mishaps, perhaps resulting in serious injury will not occur. If you or anyone in your party have any doubts or misgivings about your/there safety, well-being, or personal property, you have the right to not participate in this event, by not entering into the premises, designated foam area or other area where foam might reach.
To release, discharge and forever hold harmless, and to indemnify, Foam It UP, its employees, affiliates, owners, agents and representatives from and against any and all claims, demands, damages, fees, actions, causes of action of whatever nature and costs and expenses, including attorney’s fees, whether in contract or in tort, in law or in equity, liquidated or unliquidated, which may arise out of or relate in any way to the Event, by any local, county state or federal agency and expressly including personal injury of any nature or property damage that may be suffered or incurred, by the Customer, members of his or her family, and any and all guests, invitees, licensees, contractors or subcontractors, agents or representatives of Customer, and agrees that Foam It Up shall not be responsible in any way for any claims related to any such injury, damage or law enforcement action. The release and indemnity agreement in this paragraph shall apply to all injury, damage or law enforcement action, whether caused by the fault or negligence of Foam It Up, or otherwise.
All participants should take extreme caution, the floor and other surfaces will become slippery. Please govern yourself accordingly. The undersigned (customer) agrees to inform all participants in their party of all potential hazards and precautions, and further more accepts responsibilities for all that participate.
Pools:  We do NOT do foam parties in pools. Our insurance will not allow it. 
Adult Supervision: We require at least one adult for every 15 kids from your party be present at all times during the foam fun.  Don't worry thought it's as much fun for the adults as it is for the kids! 
We need a standard 3 prong electrical outlet and garden hose connection within 50 feet of the foam cannon. It is the client's responsibility to ensure a reliable electrical and water source is available. 
Although the foam used is considered safe, persons with allergies, skin disorders, open wounds or any other ailments or conditions should consult a doctor before entering the foam. All persons should avoid eye contact and taking foam internally. The foam may cause dermatitis, in certain individuals if left on the skin for an extended amount of time. On completion of Event, Removal of wet clothing, bathing and using a moisturizer is recommended.
The amount of foam that stays in a designated area can vary greatly, depending on factors such as temperature, humidity, type of water (hard or soft), floor surface and number of people dancing in foam. High temperatures, porous floors and large amounts of people will result in faster dissipation of foam. Foam It UP makes no guarantees regarding the amount of foam generated or the length of time that foam will last in a dance floor environment. You must protect your floors. Foam can damage anything that regular water will.
Colored / UV Foam may stain if not washed thoroughly within 24 hours. Wear clothes you don't care about. Grass, cement and asphalt are usually fine but porous flooring like some tile may leave a stain. Please consider the area you want the colored / UV foam to be blown on before booking your party. We are not responsible for any damages due to the negligence of the party host and party attendees.
Grass: If you have to treat your grass with pesticides it's advised to do it 4 days before your party and not the day of or the day before. The foam generally does not harm grass, however, on some varieties of grass, the feet running around in it can cause muddy spots, wear and tear, and /or leave temporary brown spots, much like a slip n' slide, bounce house or other water activity that takes place on lawns.  However just like anything else, the grass should recover without any problems. We recommend you running your sprinkler for an extra 30 minutes within a couple of hours of your foam party to fully wash away any residue from the grass. By booking Foam It Up you agree you have been advised of this and you agree not to hold Foam It Up for any of our employees responsible for any harm to vegetation, rate as it may be.
All permits and permissions (for the event) need to be handled by the customer beforehand and we are not liable for any issues from not getting appropriate permission.
Our FOAM RULES- We will go over this with guests before starting the party:
No running in the foam, someone maybe hiding in it causing you to trip, slip or fall.
Do not eat the foam! Keep your mouth closed. The foam will not hurt you but it  doesn't taste    good and swallowing too much can cause a stomach ache. 
Do not jump into the foam, it will not support your and you will hit the ground!
Don't crawl in the foam.  You could get stepped on because people can't see you! 
No horseplay or you will be asked to leave the foam
Customer agrees that any film or photography of participants become Foam It Up's property and may be used for promotional or commercial purposes, with no compensation whatsoever.
All payments must be paid in full 24 hours before  the party. Non refundable $100.00 reservation fee due at time of  booking. Our cancellation policy is as follows: If you cancel please do so 48 hours before the day of the party. If we cancel for some reason (weather) we will refund your deposit. No refunds will be made after the party has been started.
By accepting these terms and conditions, you authorize Foam It UP to process your order for a foam party.
